Inventory won't necessarily be devalued because of e-bike, battery testing proposal

BETHESDA, Md. (BRAIN) — Industry experts pointed out to BRAIN in the past week that existing e-bike inventory will not necessarily be devalued if the Consumer Product Safety Commission's proposed e-bike and lithium-ion regulation testing standards become federal law.

A BRAIN story April 28 said it could devalue existing inventory but it would be unlikely because the regulation likely will have a future effective day, allowing existing inventory to be legally sold through.

Also, Congress will not have to vote on promulgation, industry experts also told BRAIN. Through an Executive Order, all regulatory agencies have to submit proposed regulation to a review process coordinated through the Office of Information and Regulatory Affairs.

A debate ensued during the proposal vote last week about whether that was legal because the CPSC has in the past acted independently to promulgate mandatory regulations in the name of public safety.

The proposal passed by a vote of 3-2 and eventually enters a 60-day comment period. The notice for public comment has not been published yet in the Federal Register.
